Dear Members,

I am an electrical engineer working in a R&D group for a private company. Co-authored 1 paper. Filed 1 patent. Have a US Master's degree. Working in a very important research, is of national interest. I can get letters from experts globally in my field, with whom I have been interacting on the research.

My company has filed my PERM under EB2, but I really want to try NIW. I am not sure if I can be eligible based on low publications. I was wondering if experts here can comment on the possibility or share their experience ...

I think you should consult a lawyer.

Frankly speaking, I believe only 1 publication is not sufficient. Do you have any citations to your paper? Any media coverage of your work?

To the OP,

I would advise against applying for a NIW on your own. See if you can get your employer to file for EB2-OR/PP. Mainly because, the NIW standards have become very stringent these days. Especially towards satisfying the third prong (see/read NYDoT ruling if you are not familiar).
