Am I eligible to apply for citizenship

Hi,

Here are my details. Can I apply for citizenship. Thanks in advance...

I got green card via H1B route as a software engineer, and on my Green card it says Resident since "22nd November, 1999" That means I am a permanent resident for the past 4 years and 10 1/2 months.

I have two trips in the mean time, both for 5 months and 2 weeks.

1) From May 1, 2001 to to Oct 15,2001. (5 1/2 months)
2) From April 7,2004 to Sept,25 2004 (5 1/2 months)

I have maintained my residence all along and have paid phone/utility bill all along for the past 8 years without any break. (All along, I am at the same location, by the way).

Do I break 3 month rule/any_other_rule if I apply this week?, as I was out of the country in July/August/Sept, 2004.

5 months after Green card I quit my job and tried to start a trade business venture and later I closed it. There was a long period of time, I was not working, as I was trying to start/own business, rather than being an employee (I am still trying). I have filed all tax returns in time, though there was no income for quiet a long time.

1) When was your 485 approved ? 'Resident since' by itself is not a true indicator. Read this forum to learn about someone whose card gave incorrect info and he was denied CZ after a long wait! Was 485 approved in Nov' 99?
2) As long as all trips were under 6 month you are ok
3) There is no 3 month rule. You can apply 90 days prior to your 5 year PR anniversary.

Assuming what #1 holds, you are all set to apply for Natz. Best of luck

On my I-485 it says,

Receipt Date : December 4, 1998
Notice Date : November 22, 1999
Notice Type : Approval Notice

Can I assume, November 22, 1999 is the right date?

About the 3 month rule I was asking was about - 3 months staying in the same county???, Though I am a resident continuously, I was not physicallly present? So my doubt/question.

I never went thru 485 so I dont know if you can interpret "Notice Date" (Approval Notice) as approval Date. Sounds ok to be, but as far as this goes, pls check with someone else also....

Looks like you satisfy Physical Presence/Continous Residency clause
