am I eligible for EB1 , please advice

Hi friends,
My EB2 NIW approved in January06, PD is sept 05.
qulifications:
PhD from japan,
22 publications, 20 first authored papers
85citations
2 international fellowships
3 years US research experience
Work at US govt agency
7-8 independent refernce letters (US, Canada, japan, Singapore)
2 professional membership
External examiner - PhD thesis evaluation of indian University
Expert member for a database in bioinformatics (I am biologist)
MY attorney told me that I can't apply for EB1 so I applied through him for EB2 and got it approved, now I am thinking of EB1. Can I apply by myself?
eb1 doc, nikkasingh, and other friends please advice.

If you are a Japanese and not born in India or China, I think visa dates for you are not retrogressed. In this case just wait your I 485 will get approved sooner or later.

However based on my credientials which nikkasingh and others have given a nod for EB1 EA, you also have better publication credentials than me. Did not you get any award. You should apply quickly.

By the way I wanted some help to model (superimpose and compare the antigenic sites based on previously determined structure) influemza HA protein structure, can you help me. I am not familiar with RASMOL and I feel it is too difficult to use. Can you please helo me , I want to learn it.

Eb1-OR depends on your outstanding abilities. To me your publication records looks good. Looks like you can get more letters too and your citations indicates that your work is well recognize....try adding some more letters explaining your outstanding qualities. do you have this job as permanent one....if yes ..then go for eb1-OR ...remember its employer who will file so is your employer supporting you........................you can prepare documents and petition but your employer has to sign eb1-OR......but yes you can apply urself eb1ea.....which is like NIW self petition............all the best

My position is not permanent and I cannot apply in EB1-OR. Only chance is EB1-Ea.
I will try to get some more letters.
My question is can I apply by myself this time, or I have to talk to my attorney. If I have to go through him again, I have to pay additional, and all my original approval letters of NIW are with the attorney.
