I have been a permanent resident green card holder since june 2007. But i gone to out to my country a few time.

Months since getting green card - 69

travel outside-

1 - 11 months

2 - 1.5 months

3- 3 months

4- 20 months (took permit)

total 35.5

still I have 33.5 months presence in the US. So am I eligible? because I have read that you should not break continuity ?

Through the minimum 5 years category if there is break in residence you have to wait 4 years and one day before applying for US citizenship. So from the date you came back to US wait for 4 yrs+1 day to apply for US citizenship.Remember you need to stay for 90 days minimum at the same residence from where you will be filing.

Although you would meet the physical presence requirement if you have 33.5 months, you will be denied for failing to meet the continuous residence requirement because of that 20 month trip, unless you had an N-470 or were in the US military.

However, your physical presence calculation may also be wrong. Only the physical presence in the last 5 years is counted. If all those trips were in the past 5 years, you would have only 24.5 months of physical presence.

So even though I was out of the country for 20 months and 11 months, those 20 and 11 months will not count. But the time that i have been in the US will be counted towards my citizenship ? I will not have to start again and wait for 5 years right?

Thanks

It doesnot matter how many months I have stayed in the US. If I have broken the continuity (i.e stay more than 1 year even though on reentry permit), I will have to wait for another 4 years and 1 months and still maintain my continuity in order to be eligible for citizenship ?

Thanks.

What trips have you taken in the past 5 years? You must have no more than 30 months (913 days to be exact) outside the US in the last 5 years before the filing date. If you don't currently meet that condition, you need to stay in the US long enough until you're at the point where you have at least 913 days in the US and no more than 913 days outside the US when counting backwards for 5 years. That may mean waiting just 1 month, or it could mean waiting more than 1 year, depending on when the trips occurred.

That's just for the physical presence requirement. You still have the continuous residence requirement to worry about.

Yes, if you've broken continuous residence you'll have to wait 4 years and 1 day after the end of the trip that broke the continuity.

Yes I came back in august last month after 20 months being out. So it means 4 years and 1 month from august 2012 ?
