I am a 28 year old, unmarried, son of a US citizen. Currently I am living in this US, but I am out of status (my visa expired many years ago), so I cannot get a job. On the other hand, My I-130 was approved, and as soon as the visa bulletin indicates my priority date as 1st preference family member of a US citizen, I will file I-485.
My question is this. Is there any way for me to file an EAD on my present, out of status condition, or shall I wait to file jointly with 485? It seems I am not eligible according to the EAD guidelines, but USCIS doesn't mention my case anywhere so maybe it is possible? I am anxious to get a start on my life with work and stuff, so if possible I'd like to file for EAD even before the 485.
