Am i a concurrent filer ?

Hi Gurus

I am very confused as to whether I am a concurrent filer. I have filed my 140 on May 24, 2004 and my 485 on July 19th 2004. As far as I know my 140 has not been adjudicated in any way ( too much to hope for in 2 months anyway)

Would I be a concurrent filer per the Ohata Memo ?

Also I wanted to know what are my chances of getting a 140 RFE on my education. I have a Bachelors in Commerce, Masters in Commerce, 7 years of relevant ( and no other) experience at the time of filing , several computer courses and several Oracle / Solaris Certifications

Any help would be much appreciated

-- Yes, you are a concurrent filer. In early days, you could apply for I485 only after the approval of I140. The "concurrent filing" enables you to file I140/I485 together or seperately (even before I140's approval). And that is what you've done now.

-- Depends on what employment category your LC is filed for. It it was for a commerce related field, then you are OK. If it was for a computer related field, then it depends on the wordings on your filing. Your attorney can take care of that. He can do the wordings in such a way that your multiple degrees are qualified for the I140 approval.

Thanks pv1976 for helping answer my question. What I hear from people in my company is that they have an excellent legal department, so i keep my fingers crossed.

Any idea with the current processing times, how long I could expect my 140/485 to be Adjudicated ?

I've been reading various sub-forums and believe that concurrent filing
is only if 140 and 485 are sent in 'same envelope'.

any expert comments?

They treat all I-485 applications sent before I-140 approval as "concurrent" (some call it "semi concurrent" - although semi-c. does not exist in CIS terminology), so there are "truly" concurrent (like in the same envelope) and (semi) concurrent with I-485 sent before I-140 aproved. Except for California SC pilot program for fast adjudication of concurrent applications which lasted 90 days, I have not seen any advantage in concurrent filing over the traditional one - one waits forever no matter what. Maybe it will change in future, for the better I hope.
