Hi Gurus,

Like everyone , I am also disappointed with retrogression. I was looking for an alternate way to GC, the only one left is Schedule A wokers category. My wife has completed Medical sonography in USA, which is categorized as Allied medical sciences/technician and is certified by American registry, she is currently working in a hospital as sonographer. Currently she is working with EAD based on her pending I 485 application as derivative of my I 485 application. Is she eligible to apply under Schedule A ,which apart from nursing profession includes broadly many health care segment. If eligible to apply, is it fine or Ok to file one more when already her I 485 application is pending. My plan is to switch myself to dependent and moving her to primary applicant. I can't wait till my original application to get approved eventhough AC 21 is an option for me.

Please share your thoughts

Thanks

Kris, that's no problem! Your pending I-485 (with you be primary) does not conflict with a NEW I-485 (with your wife be primary). So it is "double security"! :D :D

No need to switch primary/secondary on the pending I-485 (if fact you cannot possibly do that), but let your wife's employer file a new one. If her employer does not sponsor, maybe they could provide supporting documentation and you just hire an attorney yourself.
