Hi everybody,
I have come across an issue. I am on H1 applying for Green Card. I am from India. My wife is from Russia, therefore I want to use her country of birth and do a alternate chargebility so that I can apply for I-485. But my wife was on J1 8 years ago and she isn't sure whether she a 2 year HRR. We have applied for an advisory opinion but haven't herad from them yet (2months have past).
My wife IAP-66 doesn't state anything clearly (the check mark is between the two boxes) and there is nothing on her J1 Visa. She is now on F2 since 1999.
What will happened when we applying for i-485, if we don't get an opinion till that time?
I am looking to apply for I-140 and I-485 concurrently.
