When you attended interview, did you see your I-140 petition?

Mine was erroneously approved for CP and sent to NVC. I had it on hold there.

Is it necessary for local office to have I-140 to approve transferred cases? If so, when my case got transferred do you think
1) CIS has requested the I-140 back from NVC;

2) they have a copy of everything so they don't have to request NVC to send the I-140 petition back; or

3) they simply transfer whatever they have and leave local office to retrieve the I-140 petition?
 
During I-485 stage, INS (aka CIS) collects pre-approved I-140 file and consolidates with the I-485 file. If the I-140 was with NVC, they would request it from the NVC. If the NVC had already sent it to Harrisburg (if I remember it right), PA storage facility, INS would request it from there. If the NVC sent I-140 to consulate/embassy abroad, the INS would request from them. These steps and preliminary checks on submitted documents are normally completed before they transfer I-485 to the local centers.

Said that, I must add that in past I have also seen CP-to-AOS approved without any of the above stages (as per reported on various Internet forums) so the answer above is not 100% conclusive though I think it applies to majority of the CP-to-AOS cases.

My I-140 (NIW) was approved for CP at Mumbai and I requested the NVC to hold it with them (it's not necessary to tell them so). Then I filed I-485 in 02/2002 and since last one month, the NVC automated voice mail for my I-140 says "the file has been sent back to the CIS." Before until eight months or so, it said "applicant's intention to adjust the status has been noted" and again before a few months or so (since around four months ago until Aug 2003) it said "case can not be found!"

INS will request I-140 from NVC otherwise INS has no means to know that you might have already got GC through consular processing. When someone approves they should have original I-140 petition and also the original labor approval.

Mine is approved for CP and recently I got RFE which might mean that my file has come back to INS.

I have the gut feeling that my file (I-140) has been back to CIS and transferred to Arling office.
 
Just called NVC. The message said "You petition has been returned to BCIS or formerly known as INS".

One stone is dropped. Now it's at Arlington office's mercy to schedule an interview.

Glad to be of help. As fikabir mentioned on another thread, interview dates (like most of the things here) depend upon luck.

My I-140 too was by their mistake approved for CP even though I asked for AOS. Now sometimes I think I better should have done CP instead of AOS!! CP is so fast as compared to AOS these days. You never know....

1) Are we going to receive a transfer notice from CIS service center or local office?

2) Will there be any change at all in the online message after we got transferred, e.g. when we receive RFE, 2nd FP notice, interview notice, after interview results (approval or pending name check, security check, etc.)?

3) Where do we apply for EAD and AP?

sometimes once gets a fax of 140 transfer

my lawyer last yr informed NVC about my intention of AOS. Then NVC later sent them a fax saying that INS has requested my file and that the file has been sent back to VSC.
I guess that would be it since later on we didnt receive any of the packets or forms that go with CP.
 
In my case, my lawyer got a notice from Vermont informing that my case had been transferred. Both my lawyer and I got a letter from the local office.
After the case was transferred the online status never changed.
I got my EAD renewed at the local office, am not sure about AP since I had no plans of travelling and never got it renewed.

I got the idea. There are no pattterns or rules to follow at CIS.

I'll fight until I get my GC; I'll fight after I get my GC; I'll fight after my citizenship; and I'll fight the injustice and unfairness forever!

All on the board, please forward our petition to Bush and your local congress members if you have not done so. Anxiously hoping and silent waiting will not attract any sympathy from these politically driven wooden-heads.
