AKP - 485 Approved with I-140 redo RFE

At last, I heard the words - "Your case has been approved". Yesterday( 10/12/2000), the automated message changed and said the case has been approved and a letter has been mailed on 10/11/2000. I waited 3 months after mailing the RFE to INS. And I waited two months after receiving the 2nd 140 approval notice.
I have seen cases getting approval in less than a month after sending RFE back. My reasoning why my case took such a long time - I think they must have misplaced my file or it was just sitting for someone to move it - Whatever may it be, it lost track. I talked with IIO at least 20 - 30 times, but they always asked me the same question - did you reply to the RFE. The reason is automated message never got updated. My lawyer asked me to wait and wait and wait. I got frustrated and contacted the local congressman. And I think that trigerred my approval. It had been three weeks since I communicated the congressman\'s office. I haven\'t heard anything from their office yet, but I am sure that they will call me after they receive something in writting from Vermont.
At last, it is approved. I should receive the letter sometime next week. Then I will post my stamping experience at Arlington, VA.

Many of us fellow I-140 redoers watched your trail blazing saga with great anxiety and anticipation, so this is good news indeed. I guess we\'ll never know why your case took so long, but for sure the latest VSC audit also contributed to the delay in processing.

If you don\'t mind, could you share the name of the Congressman you contacted.

Congratulatiosn man. Being in the same boat you used to be, your approval is going to make my weekend a bit better. Hope I, and anyone else, don\'t have to go through the pianful 3 months like you did. Have been waiting for the thing to come for almost 5years!!!!!!!

Thanks all. I cannot say how relieved I am. It was not the 3 + yr wait, but the last 2 months that made me despair. At last, I got approved in my 10th yr stay here in US.
Some of you have asked me for the name of the congressman - I live in Falls Church/Vienna/Tysons Corner/McLean area and the congressman here is Honorable Thomas Davis. I requested his help and not a senator\'s help, because somebody else had a pleasant experience going thru him. I do not remember the id of that person, but he posted about 3 months back that Mr. Davis\'s office had helped him tremondously. I will surely send the congressman a thank you card. The way it started was, I had sent an email explaining my case(RFE), and within two hours I received a reply from the congressman\'s office asking me to redo 140. They have a separate section for immigration and they know stuff.

It is time for me to chill out for sometime and then start looking for a new path - 6+ years at the same place - what do you all say?

My info -- Labor - 07/97, I140 - 04/98, 485ND 02/99, FP - 01/00, RFE(Redo 140) - 06/00, Received by INS - 07/00, 485 approved - 10/11/00. EB2.

I thank Mr Khanna for maintaning this great site and everybody who is using this site and helping others.

Thankyou for the congressman\'s name. My case is similar to yours (9+ years in the US, experience with 2 bad attorneys, 1 bad employer) Now, the 140 REDO. I feel exactly the same in the sense that last few months are terrible. Good luck

Can you please post contact info for Mr. Davis. I live in the same area as you and have been undergoing this
sufferring for more than 5 years. I have received the 2nd RFE. Mailed the 2nd RFE. Received the acknowledgement
for 2nd RFE and finally recieved the same old Shitty advice from my Crappy lawyer who will not admit his mistake
of filling me in EB3 eventhough I had a PhD in Comp Science!!

Congratulations on getting approval. I too filed I-140 redo on 28th and today I received a copy of I-140 receipt notice from Lawyer. It says, this case usually takes 140 to 180 days, but INS automated message says 30 to 60 days. I am wondering whether you had similar message for your I-140 redo in your receipt

It took only 3 weeks for my 2nd 140 to get approved. My lawyer mailed the package on July 19th and INS received it on July 25th. My lawyer received the 140 approval letter on August 25th. I do not know when and if he received the 140 receipt letter. After that it took two months for the 485 approval. Yestaerday, 10/16/00, I received the courtesy copy of the 485 approval letter. My lawyer has not received the original letter yet. I will post the stamping experience at Arlington, VA, maybe early next week.
One piece of advise - take the help of a senator/congressman if you think your application is taking longer than normal. If it is a genuine case, they surely help and can make your application move.
