Check AILA website (not sure though). But this document excerpt is pretty clear - you cannot apply your 2nd AP, leave USA before approval, then use that AP for re-entry. The basic thumb rule of AP is - an AP can used for re-entry, if the very same AP is approved before departure. Your lawyer is wrong.
