Aging-Out Issue?

I posted this question in another thread, but have not received any reply yet.

My EB1-OR was approved on 5/18/2006, with a PD of 11/04/2005. My problem is that I have a son who will turn 21 on 6/22/2007. Though I am not from a retrogression country, I cannot file for my son’s I-485 right now for difficult family reasons. By what date must I file for his I-485, please?

Hi Michael ,

I think , the best thing is to get some info from a good lawyer , wich can give more info in your sons case , also i think that the 485 should be send before your son will be 21 !!! But it's just better to contact a lawyer in this matter !!!

Child Status Protection Act

Could my son be protected by the CSPA from aging out? If then, would he be able to get a green card if he sends I-485 application within one year after the visa number becoming available (in my case, 5/18/06, since my immigrant visa number became available immediately at the approval time of my EB1-OR petition)?
