We are Canadian citizen and have been be living in US on H1B1 / H4 status in USA since Oct, 2000. My son has his birthday 0n 9/7 but my labor was approved on 1/10/07 after more than 6 years in pending because of delays at Labor Dept. My son has completed his High School and Undergrad in Michigan. Now, he is in a Madical School in the Caribbean, and his H4 was expired in Feb, 07 per the document though his birthday was Sept. last year. Can he be protected for age-out (current age: 21 years and 5months) by some way so his green card processing can be started with me?
