I have searched this site and the internet; I am sorry I am so very concerned.
My wife was just convicted of an aggravated felony by the state.
6 Month jail sentence (time served)
plus two years probation.
She has been in the USA with a green card for 9 years. She was convicted of aggravated identity theft.(there was no money taken; no restitution)
I have read that when she renews her green card she would be deported...or a proceeding to start that process.
There seems to be no waiver or hope. I am a disabled veteran and have a three year old little girl.
Is there a way to prove to the immigration courts that this was not an "aggravated felony" by their standards?
Does anyone know of someone that is a permanent resident, that had a serious charge get the green card renewed? Or is there very little chance?
Please help me, I am so worried, please.
