After Immigration Court

Hi,

I just wanted to get some info. I won my case in immigration court without a lawyer and the BCIS said they wanted to appeal. After the hearing the BCIS guy told me that I wouldnt have to worry since they rarely ever appeal Asylum cases unless there was some arguement about the law or the IJ made a bad judgement.

Anyways 30 days passed without them appealing and now I am wondering whats next. Do they send me a I94? Or do I have to go get it myself? I have a min. brief from the IJ granting Asylum plus on it the BCIS reserved appeal and the final date is on there for the BCIS to appeal.

I want to start school in fall and you know how uneducated the public is about Asylees so thats why I want to get a I94 that states my status. If anyone had a case infront of IJ I would like to hear what happened afterwards. Feel free to instant message or relay your answers in this thread.

As a general rule they do not issue I-94 cards to people granted by the EOIR. The IJ order will serve as evidence of your status. You may want to call the 800 number to make sure no appeal has been filed by the BCIS. If so, then go to apply for a social security card.

Thanks for the advice, I'll go in on Monday morning and get a unrestricted SS.

I am just worried about the financial aid since it states:

An eligible noncitizen is one of the following:

A U.S. permanent resident who has an Alien Registration Receipt Card (I-551 or I-151)

A conditional permanent resident (I-551C)

A noncitizen with a Departure record (I-94) from the U.S. Immigration and Naturalization Service (INS) showing any one of the following designations: "Refugee," "Asylum Granted," "Indefinite Parole," "Humanitarian Parole," or "Cuban-Haitian Entrant."


I dont have a I-94 and I hope it wont be a problem to start school. :(
 
When you apply for financial aid, you have to provide your A number on the FAFSA form. The Department of Education will attempt to confirm electronically your aid eligibility with BCIS. If the match is successful, the DOE will tell your school of this fact and the matter will be considered settled. Only when the match fails will the school ask for documentation from you for submission to BCIS.
