after filing 140, how can my husband answer the qustion in 156

I filed 140 and added my husband name in.
currently my husband is in china.


1)when he apply visa on the consulate in china,
he should fill yes or no for the question in I156 form
(has anyone ever filed an immigrantion visa petition on your behalf)


2) if he answer yes, can he apply H1-B visa in china? How about H4 visa or B1 visa?

Primary Applicant in the filing

If you are the beneficiary of I-140, then your husband should say No for prior immigration visa petition.

If your husband is the beneficiary, then he should say Yes. Answering Yes doesnot automatically disqualify the visa petition.
