affidivit I 864 requirements for joint sponsor

hey guys,
i have joint sponsor who is willing to fill out I 864 , my question is , what else does he need to include as a document. I mean i know they need recent tax return , proof of employment, and proof of citizenship. so , whats form 1099?? is it necessary ?or copy of recent tax return will do it? what about pay stub?
is recent pay stub required>? as well as tax return ? if so , copy of pay stub or original one? instead of sending pay stub can we send letter from employment ? guys please drop some words ....i appreciate it.

I-864 (notarized);
2005 tax return (IRS transcript, or a copy);
W2, 1099... - whatever he received for 2005;
Proof of employment - a letter from his/her employer OR a copy of a recent paystub;
A copy of his/her green card or Passport.

dont forget to include I-864 from the primary sponsor. Anahit's list is all you need. Good luck.

when u said W2,did u mean the originals or copy?
i assume that tax return means the one ur tax agent gives u in a folder???
and copy of paystub or original?? thanks a lot guys

Ill answer that for you :)
Copies must be submitted unless originals are specifically asked for.

As for tax returns, you can call IRS and get tax trasncripts which is what the USCIS looks for.

Only I-864 should be notarized and original submitted, copies are sufficient for other documents.

u know as u said , about chat transcript(which will take 7-10) days after ordered to get it. umm did u say we can either use copy of tax return (the one we get itfrom tax agent) or chat transcript? just wanna make sure coz i might hav eto wait for 10 more days to get it...well thanks as always
 
Why wouldn't you take with you at the interview originals AND copies from your sponsor's tax return ? They will ask for originals but take the copy. Take also both original and copy of the certificate of naturalization. And you should also take proof of employment AND paystubs (make copies of paystubs). Better be well prepared !!!

Hm, we once were transferred to an IO on the phone and he said that tax transcripts were not sufficient and the USCIS would need the full tax returns.

Apparently because on the transcripts only the adjusted income is mentioned, but they want the unadjusted income.

But even though it was apparently and IO, I'm not sure whether to listen to him or not, because he also told me that I still needed three tax returns when really I only need one. :confused:

lol.. not chat transcripts, they dont need that. ;)

you can send the your 1040 with your I-864, but make sure to carry everything to the interview.

hmmm...This is what happened during my interview. The officer wanted my tax return docs for 2004 since he could not find it in his folder. I gave him the W2 and 1040 which he accepted. Then i told him i also have IRS transcripts. He immediately returned my W2 and 1040 and took the IRS transcripts and told me that was exactly what he needed from us.

As for the memo from USCIS, you only need tax documents from the most recent year and not three as required earlier.

Hi guys,

Am going to submit my application on monday and going through this thread, I will like to clearify the issue on tax.


1) My patner has had gone to notorise the affidavit today but the tax return we are sending is the one he got from the tax agent and also a copy of his W2.


2) My brother -in-law that is acting as co-sponsor sent all his tax documents, pay stubs & house title

What is the Tax transcript & do I have to submit is now or can we take it to the interview if we don't have it now

Are this enough

The transcript has almost the same information as the tax return, I'm not sure though what it is. As long as you have the copy of your tax return there is nothing to worry about!

oh boy. i know nothing more than the information that is public and available to everyone ;) I can tell you for sure there are more informed people here on this forum who actually know immigration laws and who are lawyers. Actually the transcript has more detailed information than the 1040. Since it is from IRS, it is proof enough that taxes were paid.

feranmi, for now, the 1040 or equivalent should be fine.
 
It makes sense when I read it now, but I never realized this earlier - the recent W2 :(. Two days back we sent the I-864 (as a part of I-485 package) - Affid of Support from me and joint sponsor - my brother. Both my brother and I, sent a copy of our 2004 tax returns, because at the time we were preparing these documents, neither of us had filed 2005 taxes... but now reading this thread, it seems like sending the 2005 W2 would have been a good idea... well the boat has already sailed for me... and I might get an RFE... but am hoping that someone will chime in here n say that the missing W2 is not a big deal $$ (fingers crossed).

As for the tax transcript - God... I am really disappointed by the IRS dept this time. We had all the papers ready by first week of Jan... I was planning on including my tax transcript for 2004 and ordered it some time in Jan... waited 3 weeks for it and then called IRS again... only to find out that their system was missing my Apt no... duhh... I gave them my full address and waited for another 2 weeks... and then called them again and yet again I was told the same story... that the system did not have my apt no :o can you blv that? I gave them my correct address YET AGAIN... its been around 10 days and no news from IRS. We decided to include a copy of my tax return for 2004 and mailed the documents on Mar 1st :)

From what i make out from instructions of I-864, W2 is needed only in this case: You filed taxes jointly with your spouse and are using "ONLY" your income to qualify for the Affidavit of support. In this case you submit your W2 to show how much you part of the income was. The 1040 would show joint income.

I dont think you would get an RFE for a missing W2, as long as you submitted the 1040's. Be prepared to carry everything to the interview as you would definitely be asked for tax returns from 2005.
