Affidavit of support

Hi ,

I have 2 questions on affidavit of support that my souse is suppose to fill out for me.
I have h1B visa married to a USC.
1)Question 8th of affidavit asks: If the person is depend on you. wholly dependenth or Partially dependenth.
Since I work what would be the answer?

2)Question 11 asks: I intend do not intend to make specific contribution to that person.
What the answer should be? Since We are a couple what could be the best answer.

I agree with Praetorian on this one.

eli123, there are a number of forms that are called "Affidavit of Support" and it seems like you're looking at the wrong one! Incidentally, you may also want to look at if you qualify for filing I-864 EZ instead of the more general form I-864. Form I-864 EZ is a simpler version of the affidavit. The form mentions the criteria for which you can use I-864 EZ. In a nutshell, if (1) your spouse that filed your I-130 petition is your sponsor, (2) you are the only beneficiary listed on this I-130 petition, and (3) you only use your spouse's income reported on W-2's as the basis of meeting the income requirement for the affidavit, then you can use I-864 EZ. If you include assets or your own income instead of or with your spouse's, then use I-864.
 
Dang it, I should have filed I-864 EZ.... well, one learns with time and experience right? :)...

Now where is my Interview Appointment?!!! :mad:
 
I130 question

on i130 question 17.
list husband/wife of your relative.

my husband is filing I130 for me. should I put his name on the list again?

I applied for I1485.

My husband (he is self employed) has filed these documents with affidavit of support. His income is enough to support me.

Schedule A,B,D,E and 1040 for year 2006

We filed our joint tax on 2006.
When we filed for affidavit of support I didn't add my w2 form since I thought he is the sponsor.

Now I have received a letter from immigration that says the initial evidence for affidavit of support is incomplete.

Is this because of my w2 form ? Or we are missing something else?
On the letter it is not clear.

Please advise

I see this question a lot. It's a mistake that's intrinsic to understanding how US tax filing works, I'm assuming that's why so many applicants miss it.

It's not enough to file the forms that were submitted with the tax return to the IRS, i.e. the 1040 form and schedules, and the W-2. You need to include any and all information statements you receive and did not file with IRS. If you filed schedule B and D you'd have one or more of these 1099-INT's, 1099-DIV's, 1099-B's, etc. and there may be others. Essentially, a copy of anything you receive in the mail related to your tax return needs to be included in your I-864 filing even if you did not have to file it with the IRS. The USCIS will not accept a copy of your tax return without a complete set of information statements.

The information statements are statements that a company sends directly to the IRS and a copy to you. Therefore, it is not required with the federal return, but the USCIS wants to see them too.

Anyone who finds this too confusing probably needs to go the other route, to request an IRS transcript instead!

Incidentally, you need to include your W-2 as well. Since you filed jointly, you would have submitted your W-2 as part of your 2006 tax return. You need to file a complete copy of your 2006 tax return plus information statements you did not file with IRS!
 
I guess I should probably tell what we did, since we haven't received an RFE for the tax forms (yet). I'm in the same situation, H-1B and filed jointly with my wife for 2006.

For our 2006 return, we submitted to USCIS our Form 1040, as well as Schedules B and D, Form 1116 (foreign tax credit), Form 1116 attachment, Form 1040-V (payment voucher), a copy of the check with our payment, both our W-2's, several 1099-INT's, -DIV's, -OID's, and -B's, and a 1098-T for tuition paid. Basically everything we received and filed for 2006 taxes.
 
You could just edit your post and include all of this information :p.

I will come back and ask you questions when Tax Season 2007 comes around though ;)

But I do realize it would have made it easier to read on something like, let's say, an iphone. Not sure where I get the idea... ;) :p
