My friend got married to a us citizen girl. His wife does not make enough money so he is asking me for an affidavit of support. My questions are:

1- What would be my responsibilites as a supporter?
2- Is there any risk invloved?
3- Do I get a penalty if his case denied or based on a paper marriage?

Please help !!!

Maybe someone has seen a case where the Gov't has enforced the support provisions of an Affidavit of Support... I have not seen one. Now lawyers in civil cases, specifically divorce cases have tried to enforce it.

Just don't lie and you will not be penalized for their application.

1. As the Affidavit says you will be responsible for the beneficiary in financial terms avoiding that the beneficiary use public resources until the beneficiary (if it's granted residency) work for 40 credits and some other factors, you can check at www.uscis.gov

2. Well that is your personal call. Normally family members, since is a relative are the most common to get involve. I don't know how close you are from your friend. The US goverment hasn't enforce so much the Affidavit of Support and as Sometime2006 indicated me either have seen once that situation of happening. Does not mean that could or won't happen.

3. You have nothing to do with the rest, just with the part of Affidavit of support. But talking about what is right or what is wrong, then you should ask yourself if it's good to participate in something against the law (like a fake marriage). If the case is denied it has nothing to do with you, the beneficiary and the principal sponsor are the ones who must submitt the propers documents to demostrate that the beneficiary should be granted LPR status.

Good luck,
