Affidavit of Support (I-134) for wife's I-485

Hi,

I am going to file the EB1-OR packet soon (I-140 for me, and two I-485's -- one for me and one for my wife).

For her I-485, as I understand I need to attach I-134 signed by me and notarized.

If that's correct, what should I select from (a)-(d) in Item 1? None of those seem appropriate.

Also, I put my wife's data in item 3. Should I list her again as "wholly dependent" in item 8?

Do we attach the original notarized I-134 to the wife's I-485? Somebody here mentioned that he sent a copy of I-134 and didn't say where the original go.

If you were born in India or China, you should make sure if you can submit I-485 petitions for you and your wife after 10/01/2005.

Just Type [N/A]

As far as I know, you should submit the original I-134 form notarized at a bank or somewhere.

I have no recollection of having to fill out one. I've always been under impression that this is only needed when a person actually enters the country.

Lamonte: We are already in US; I am on H-1 and she is on H-4. Was it the same in your case?

I am pretty sure a lot of people here had the same experience (husband on H-1 and wife on H-4; wife does not work; husband files I-140 + I-485 and wife files I-485). Please share experience -- is it necessary to file I-134 or I-864 by husband for wife's I-485? Thanks a lot

USCIS web site is not clear on this point, it mentions I-864 in case of family immigration, and for the employment-based immigration nothing is said about dependent's I-485.

Lamonte/honkman/leroythelion/anybody_else? :) again, it looks like a lot of people went through that in this forum.

Yeah, that's how we were. I know that I did not fill out the form, and I did not ask my employer for any sort of financial info, but I signed a power of attorney form for my lawyer and he works extensively with my <former> employer so hypothetically he could do it without my involvement. Although I really don't think so.

logicators: thanks. Just to double check, which form was that? I-134 or I-864? Did you also attach W-2 and/or tax returns and/or bank statements?

Just checked, and it was I-134. I did not submit W2s, but I did submit bank statements and other financial documents.
