My Husband is H1b visa holder.He wants to sponsor me and my son from my first marriage.My son is 4 years old and I have the sole custody of my son.Is it necessary to get the consent of my exhusband or as I am the Gaurdian now,such issues would not rise?Please some suggestions are welcome

From US immigration point, it should be ok as you are biological mother. Just include your son in the immigration process and you should be fine.
I don't know much about Family law in your home country regarding this matter. You are planning to take your son out of country and there might be visitation issues. Kindly check with the lawyer/attorney who assisted you with your divorce, he/she might be able to guide you better.

the only issue i see is that the dependant is of the principal applicant, and there has to be a direct relationship with the H1 holder, which in this case does not exist unless he has adpoted ur child. But a letter of consent from the child's natural father may work as well.
