Advise on Tax filing and I-485

Hey guys,

Can I claim my sister as my dependent when I file my 2004 income tax since my I-485 is under process after they approved my I-140. She is F1 student. We live at same place and I am supporting her financially ie her tuition and stuff.
Just wondering if I should claim her or not. Please gimmi some feedback. Thanks!

I 485 and filing of tax returns are two separate issues. You should be able to claim your sister as your dependent, subject to certain restrictions. Check with your tax consultants. They should be able to help you.
 
Thanks New Age gc,but I will have to show them my past tax return for 3 years later on, at that time they may ask me why I am claiming her since she is in F1 status, I have no clue in this tax thing, just trying to find out how this works before I take further step. Just wondering eventhough she is in F1 status still can claim her as a dependent or not. Does it make any diff. in my case later on?

Yes you can claim your full time student sister as your dependent. It is legal so you do not have to worry about USCIS. There are 5 dependency test to met. You can claim her 'coz she is full time student, living with you, you are supporting her 100% financially, she is your close relative, living in USA (does not matter in what status), she is not filing her own tax return, she does not earn a minimum amount (about more than $ 3,000) anybody else is not claiming her as dependent, etc.

Anyway, bottom line is she is your dependent. You may check IRS.com to find out the exact wording of those 5 requirements for dependency test.
