Advise on H1-B Cap

Hello All,

I'm in the US on L1-A visa for the past 2 years. I was planning to do my H1-B. Didn't expect the quota to be filled so soon. Its very surprising.

Now I'm exploring the possibilities of doing my H1-B. I had my H1-B approval in 2003 (Approval duration: 03/2003 to 11/2005) and also got the passport stamped. Subsequently when I got the L1-A visa stamped, the previous H1-B stamping was canceled.

I have gathered some information on H1-B cap. Is it true that as per immigration law a person who has been counted against the H1-B cap within the last 6 years, should not be counted against the cap or quota again? Is it possible to file H1-B petition now showing the reason for exemption under the H1-B cap?

Please advise.....
