Hi Guru,

I applied for an Advanced Parole since my 485 is still pending after got transferred to NYC local office in April of 2002 (Yes, it is very frucstrating that the NYC local INS does not move much on any 485 cases).

I received a notice to show up in the NYC local office regarding the Advanced Parole application, alone with the following items:
a) passport
b) copy of 485 filing
c) any INS-issued documents

Have anyone had any similar experience and/or dealing with the NYC local INS office?

Any sharing will be much appreciated!

Though I don't have personal experience, I heard that NYC center will issue you AP on the same day when you show up with these documents. To be on safe side, I advise to take pictures for AP, too (in case they lost previous ones!) and the I-485 transfer notice (so that you can ask when to expect interview).

I have noticed that on average, NYC takes 8 to 9 months for interview notice (and 10 to 12 months for interview) from the date of transfer. I wish you get your interview and GC very soon.

By the way, do you have any guess why your case could have been transferred - like NIW, EB-1, changed-employer/address, etc.? If your case was NIW, did your employment letter described duties too (in order to correlate with those in I-140 NIW)?

Thank you and best wishes,

Jigesh

Thanks for your input...
I have no ideas why my case got transferred to local office as there is no special events that I am aware of it will trigger that...I am not too sure if that is random or just whatever....sometimes, it is hard to predict how INS functions....

What is NIW?
Thanks again

NIW- National Interest waiver

This a special category filed under National interest (Extraordinary)

Usually PhD's file in this category.

In this category, You can skip Labor and directly jump to I140

Thanks for the explaination.

Do you happen to know if "state of residence" has anything to do with the speed in terms of when the 485 applications got approved. VSC is responsible for processing applications from quite a few of states. Someone on this messageboard seems to think NY filers have the WORSE luck...Is this true?

thanks again.

As skn2k said, NIW is an acronym for National Interest Waiver - where labor certification is waived in national interest, in principle.

Nobody says it loudly though that state of residence plays any role in I-485 adjudication process. However, I have also observed (may be a coincidence??) that apart from MD-filers, NJ-filers are amongst the firsts to be approved; and of course, we, the NYers are the last (if not transferred to local centers). Not complaining - just putting down my observation.

Best wishes,

Jigesh
