i applied my green card in 2000, and have not gotten any notices so far. i wanna apply the GC through employment, but i am just afriaid that if i do that, INS will suspect that my case was fake. i thought that asylee can only apply GC through asylum based, is it true?
Is anyone applying GC through employment NOW? how it go so far?

(if this has been discussed, plz let me know the link, so that i can read, thx!!!!!!)

If you applied for your green card, based on asylum, in 2000, it is projected that you will obtain your green card in 4 to 5 years. I think in order for you apply for green card based on employment, this will mean that you will withdraw the other application that is based on your asylum. In my opinion, this is a huge risk if you are not confident that the new green card application that you base on employment will be guaranteed. If I were you, I would be more concerned by the level of risk in pursuing a green card based on employment than to be worried about the INS perception of you. As for you fears regarding the INS, I do not think that they could determine that your asylum case was bogus unless they have a powerful evidence against you. They already screw up asylee everyday and consistently minshandled their cases to the extent that they got sued. In short, you really have to weigh your options regarding which application is faster and guaranteed and do not worry about how the INS would think of you. Good luck
 
so i cannt apply my GC that based on employment or asylum at same time?
i heard that applying GC based on the employment is faster, since few ppl are applying now (ppl got lay off)
And i do worry about my GC based on my asylum case, it just take so long and i was worrying about that INS might forget about my application since it been long time ago.

I am pretty sure.

Would I bet my ranch on it? No.

But I know half a dozen peopel who have done this or are doing this. I also have an internal INS memo issued many years back saying this was not only permitted but also encouraged (in part to alleviate the asylee adjustment backlog which was a serious problem then as it is now). It is a hard copy so I cannot upload it.

In sum, I am quite positive that as asylees we can have more than one adjustment request pending at one time.
 
gilbert, when did u apply your GC? have u gotten anything yet?
i believe Tim Zheng sent his in 2000 as i did, wonder if he got anything so far:)

recently fingerprinted and am expecting (based on private and public information) an approval letter any time.

one more question, did INS send u the letter to the address that is shown on your I-485 receipt?
i am asking because my asylum case was granted in LA, then i moved to seattle, i dont think i told them, but when i applied my GC, i did put my current address, and the address is shown on my I-485 receipt.
hopefully,INS wont get confused, do u think i should call them and see what they have on their computer??

Granted in August 98 applied inOct 99, INS officer told me receipt date is Dec 99, still waiting.
I think they are processing 1998 now.
long way to go at least 2 years for me.

I can file my asylum based 485 now (Nov, 2002). Should I hold it? Because I am preparing the employment based immigration now. And if everything goes smoothly, I could know the result of my I-140 by June, 2003. If my I-140 gets approved then, I could file employment based 485 instead of asylum based one. If my I-140 gets denied, I could file asylum based 485 then.

To Hold filing asylum based 485 now is a right choice? This will avoid lots of headache? But the price is late approval of asylum based 485, right?

It is really up to you if you want to file your I-485 now. If you file your EB I-485 next summer, you probably will have a decision no later than summer/fall 2004. So the risk is that if the EB application does not succeed at the last minute, you would be behind by four or even more years in the asylum adjustment line.

It costs about $300 to submit an asylum-based I-485 (you do not have to do the medical). So I guess the question is do you want to purchase an insurance policy for a $300 premium?

You can have as many applications as you want.I consulted with an immigration attorney several months ago about the same issue.I also called INS they told me the same thing.The reason why i inquired is because my wife whom i married in June of last year offered to file I-130 (immediate relative),I am just waiting to see how things are going to be like since i recently did my FP,if i don`t get anything in a couple of months then i will proceed with another application.If i get the GC through marriage then i will have to call INS to cancel I-485 based on asylum,if i get it based on asylum then i will call INS to cancel I-130(based on marriage) Good luck.
