Advice on H-1 Extension.

My I-485, EAD filed on Oct and my H-1 is going to expired on Apr. 2002. My company lawyer refuses to file my H-1 extension, since she thinks I can get EAD. I think no body can say what\'s going to be happened. The safest way is to file extension anyway.
What\'s your guys advice?

EAD may ok

We have the same situation as you. My husband\'s H1 will expired in Dec. the lawyer suggested him go with EAD back in July before file 485. He agreed and both our EAD had been approved 2 months later.

It\'s unlikely that the EAD approval takes 7 months (Oct-next April). Most important thing is as soon as you apply for EAD you will be in legal status even your H1 expire. The only risk is that is you lost your job while your 485 application less than 180, your EAD may be invalid. While if you have H1 you will have the same risk, more disadvantage for H1 is you can\'t easily find a job with H1 transfer but you can with your EAD. I think the lawyer\'s suggestion is a better one. Make your own decission. What I said is my own personal opinion and experience, no responsibility for any one else.

Both your lawyer and helen young are correct.

The H1 extention is not the safest way to go. It cannot assure you the job security. An EAD will give you a better choice according to my experience. My lawyer didn\'t point out the advantage of the EAD, which brought me much trouble now.

I know from the perspective of the company lawyer, H1 extension is much more expensive than the EAD. They want to save money for the company of course. But you turn out to benefit more if you apply for an EAD.

My point is that I would like have EAD and H-1 extension both ready. Double secure. Am I greedy? :-)
