Advice on going AOS or CP for my situation

Folks,

I had my I-140 approved in EB2 NIW category on Apr 22, 2005. I am currently working in the Canada office of my US Employer as my H-1 has expired and am debating on how to proceed with my third stage. My wife is still on the US on her H-1.

I go to the US as an H-4 dependant on my wife's visa and apply for my third stage AOS and wait till I get my EAD and resume work. Is this permissible ? I will have to go on a leave of absense from my employer when filing for my AOS. Can the primary applicant of the AOS be on an H-4 visa while filing ?

CP in Montreal

My I-824 is approved. What is the wait-time for interview in Montreal ? What are the next steps for getting the CP interview date and how long does it take ?

I would appreciate advice on how to proceed in this regard.
