Advice on asylum application for a sudanese

I'm from the Sudan, have been in the U.S for the past 5 years so I guess that wouldn't help much as I know there is a 1 year rule for asylum. I haven't thought about asylum before thinking things might change in my country as I always wanted to go back. In a few days from now the country would be split into two and the government would even have more control on the part of the country where I'm from. Having been arrested by the government security forces before, I'd be more reluctant to go back now. What do you guys think my chances are, any advice/recommendations would be much appreciated. I'm not too worried about my status now, I'm here on a student visa working towards a PhD degree and would be done by 2013 if all goes well. Thanks.

You have an exceptional circumstances which falls onto 1 year exception: as long as you maintained your legal status, you are fine, because you were in legal status. Another excuse from 1 year rule is the changes in your country. But your subjective reason (being in legal status) is enough not to worry about the 1 year deadline for asylum application. GO to consult a lawyer, they will say the same. Good luck!
 
Separation impacts northerners more so than southerners. The Sudanese government is the cause of all problems in the Sudan, at least southerners will have a new government and will enjoy some freedom from the dictatorship in the north. However people in the north have to still deal with the same regime that have been oppressing them for the past 20 years. Also no one knows if it's going to be a peaceful divorce or not.

Putting on the Asylum officer hat this wont get you asylum since it is too general of a statement and does not merit an exception to the one year rule. You have to show why this event materially impacts your individual situation and it cannot be based on speculation.
 
Sudan is under TEMPORARY PROTECTION STATUS right now so that will help alot though but don't give up,, be positive to what you want
