Advice needed (485 and EAD) - 6 days left

Hi


Please look into our details and give your advice. I am still working under H1 but having EAD.(Not planning to use my EAD until my H1 expires). My wife is working by using EAD. Here are the details for both


485 ND : Jan 23, 2002 (wac-02-093-xxxxx)
FP : Nov 01, 2002
H1 visa is expiring in Jan 2004(6 years)
EAD is expiring in june 13, 2003
AP expiring in march 30, 2003


Considering the 485 approval speed in CSC

1. Do I need to renew my EAD or wait for another 6 months.
2. Do my wife need to renew her EAD. I think Yes, because CSC is not going to approve my case before June 13, 2003.
3. Is it necessary that primary has to apply for EAD because of spouse is applying.
4. Do I need to apply (EAD & AP) through my lawyer or can I apply directly(Just to save some money)

You don't have to unless you want to !

If you do not want, you may refrain from applying for renewal of EAD. It is not neccesary for you to file for EAD just because your wife has to. I am pretty sure on this but, I would suggest you consult with your attorney before taking any decision. As far as I know, your EAD would be restrictive while your wife's not. Which means that you have to take a job using EAD in a similar position you are currently working in. Your wife however can take up any job in any field in any position.

2. Yes. She needs to have EAD as she is working and if she wants to continue working.
3. No. Both are independent with respect to EAD and AP.

I would suggest apply it, who knows you may not get GC by jan'04. So why to take chance play safe. It is a matter of $120 only.

you are right apply for her ASAP within next 6 days and be safe, for you refer 1.

You can apply by your self, it is very simple. there are number of ppl on this board who would help you and also there was a FAQ on this board.

Good luck but don't forget to file atleast for your wife in next 6 days.
Since from 13 march to 13 june it is 90 days.
 
EAD question?

Thanks to all for your valuable response. Here I have one more question.


I am applying for my EAD renewal. In the application, they are asking 'copy of my last EAD' ? Is it the copy of the EAD card or any other document.

A small addition to Vipsha's reply: You should invest in EAD
for yourself too. Yes, you do not have plans to use it, but
the times are difficult and people get layed off every now
and then. If this happens, it is very good to have a valid
EAD in hand since many employers have no problem hiring
people with EAD but would not do the H-1 work for new hires.
Again - do it in the next few days to be safe.

Thanks again for all your kind advices. To be in saffer side, I am sending the EAD renewal application for self and spouse today.


I will post once I receive my Notice on hand.
 
Cheque cashed by INS

EAD renewal Application mailed (normal postage paid - $0.83) to INS on 10th march 2003.

My bank statement shows that the INS cashed my cheque on(14th March 2003).

Does it mean that my renewal application is accepted by INS and I can count 90 day from the 14th march for my iead.
