advice from my attorney

Just talked with him and here is the summary of what he told me:

It looks like I should be approved by the end of the fiscal year of 2005 since they asked for RFI. I got approved asylum in 2001 and RD is April 2002.

No need to send medical, although I am covered 100% by insurance. Per him, based on settlement, INS has to establish a database of chronological order to make sure they approve based on receipt date. Any delay caused by their internal problem, such as requesting additional info, would make them to explain to the court. Unless you filed something piece by piece (I did not), you should not worry about losing anything since it is microfilmed before sending out receipt. INS never says it would deny your application for missing I-693; it says it may do so. (He joked that "they can change the sentence to be: if you don't have I-693 with I-485, we may make you president of U.S.") They can, they would deny application if you intentionally miss material information, not I-693. Bottom line, if you don't have confidence that I-693 was with I-485 when you filed them together, why you have confidence that it will be with I-485 when you are going to file it seperately. There is no guarantee that your second medical will be with I-485 anyway.

He reminded me of sending back the response ASAP, since it looks they should process them immediately after receiving it otherwise they won't be able to make the date by processing altogether.

I just sent the damn thing out via registered mail this morning.

Could you please post your timeline. After reading your post, looks like your I-485 receipt date is April 2002 and you already have an RFI?
I didn't know that people with RD of 2002 are getting these RFIs. Please don't misunderstand me, good for you if you did. I'm happy for you.

Approved in March 2001
Mailed I-485 in March 2002 and got the whole stuff returned because "missing medical"--it was not missing just sealed in a blank envelop like a bomb--joking
Actually receipt date is April 2002
Got fingerprint in August 2004
Received RFI yesterday morning

Did u submit G-325A even you didn't do I-693 AGAIN? It looks like two part:
1. I-693, Supplemental Form to I-693 ;
2. G-325A

What exactly you submited in your response this morning? Thanks a lot!

My ND is March 2002, how come I haven't heard anything yet?

I just sent the G325a and included a statement that I-693 or whatever I-693a (I never saw the thing called I-693a.) was in a sealed envelop along with my I-485 submitted in April 2002.
