Advice anybody?? :(

Hello!

(I hope this is the right place for my thread)

I have been in the U.S. since the beginning of 2005 now. I was inspected by an immigration officer and entered the US with a B-2 Visa.
My husband filed form I-130, the Petion was approved, receiving the approval notice beginning of 2006. Since then, nothing really has happened:( , shortly after the Approval notice we moved to another state (my husband is in the military). I send the change of address form to USCIS. That was it.........

Until now, I was thinking I was lawfully in the US, because I was inspected by an immigration officer and the petition was approved. I did not know that adjustment of status has to be filed within a certain period of time..........

Help, what do we have to do now??
Am I still able to file for adjustment of status (I-485)??

If your husband is a US citizen, yes you can file your I-485 Adjustment of Status application now and your overstay will be forgiven.
If he is a green card holder, you will have to wait until your priority date is current before you are able to file your 485. Also in this case you may need the advice of an immigration attorney to overcome your overstay.

If your husband is US citizen you can apply the I-485 now. It is important to avoid traveling out side US until you get the Actual Card
