If I use RIR appying LC, but the advertisement is more than 6 month (just 10 days), can be exempted ?
 
I assume you mean "10 days over 6 month".

Don't worry, there is no fixed period. More is actually better.
 
If what yadress means is that the last advertisement was posted more than 6 months before he/she files the application, might that not be a problem? As far as I can remember, DOL asks for a test of labor market within the preceding 6 months of an application.
 
If you are implying that your company ran a recruitment advertisment campaign for slightly more than six months, then more power to you. Its helps your case.

If you are implying that your last advertisment was run 6months and 10 days back, that could mean trouble - you have to show that u ran a recruitment campaign for a period of 6 months immediately prior to your labor filing.

I completely agree with the statement...

Few of my colleagues Labor was moved to non-RIR in CA because the they missed this ad guidelines by just a couple of days ie., last ad of the series of ads was posted 2 or 3 days over 6 months before filing the labor.... You can not argue in these market conditions over such technical issues, esp. if happens to be an IT case....

For the same co. we have had cases where labor was approved from same SESA without even paper ads back in '98, '99.

But this advertisement was put on Febuary,2003. The closing date on the ad. is middle of March, is it possible to try now?

You have not mentioned which state you are applying from.....
In california, the DOL is looking for some way to deny RIR.
so in an instance like what you have mentioned, it gives them an easy reason to deny an rir.
u dont want to wait for more than 2 years (in calif or ny) and then find out that ur rir got rejected....
however if u r filing from a faster processing state like dakotas, iowa then u probably might take a risk - however consult a competent attorney.
