Hi All-

I have a question about marriage based immigration and travel.
I have a valid H1-B visa until May 1, 2002. However, I got married to a U.S Citizen in January and filed my AOS in February.
I received my Advanced Parole and Work Permit in February. I need to travel outside the country. What do I need to show, my H1-B or my AP on the way back? ( I will return before May 1 when my H-1 B expires). I do recall that when I went into the immigration office to apply for AP in person, they put my H1-B Visa in through the INS scan machine. I am not
sure if that voided my H1-B in some way?

On a related note, has anyone traveled to Boston with AP document? Is there any other additional docs that the immigration guys need besides AP, Visa and Passport? I have never been out of status to the best of my knowledge. Is it posible that I am out of status and not know about it? I am just a bit nervous...:)

Thanks much for the help

no need for advance parole for H1b holder

You do not need an advanced parole if you are on H1b (any attorney would confirm). Sorry you paid unnecessary fee to receive your Advance Parole.
Read what INS says:
Advance Parole: If you have applied for immigration benefits, you may need Advance Parole to be able to return to the United States if you travel abroad. It may be sought by, but not limited to, asylum applicants, parolees, people with Temporary Protected Status (TPS), and people who are applying to Adjust to Permanent Resident Status... This requirement does not apply to people who have applied to adjust to permanent resident status and are maintaining H-1 status (temporary workers in specialty occupations) or L-1 status (intra-company transferees), or their dependents in H-4 or L-2 status.)
