Advanced parole question / interview at Pitt

Hi All,

I am an US citizen and I applied for green card for my wife (I-130, I-485 and EAD) on May 25, 2007. We received our EAD a month back. Today (Sept 24) we had the interview in Pittsburgh. Everything went fine. We were asked to show our IDs and some pictures. It lasted ten minutes and was pleasant. However, the name check was pending and therefore we did not get any stamp in passport. The officer said he is approving our application and the name check may take anywhere from month to years!!

My wife is currently on H1b, which is valid till 2009, but she is planning to accept a new job based on EAD (therefore will lose the H1B). The new job requires international travel. I did not apply for advance parole, arrogance (or stupidity) on my part : - (

I read that I can apply for advance parole now. I also read that since I applied for I-485 on May 25, 2007, I do not need to pay $305 fees. I am correct in my assumption that I need not pay the fees. Also, how long does it
take to get the parole? Is there a way to expedite it?

take to get the parole? Is there a way to expedite it?

Wait for others to respond, but I think you still have to pay the new fee. From my understanding you do not pay the fee if FILED CONCURRENTLY.

Hope I am wrong though.

Just wait and see.
 
This is from the instructions for filing I-131. Based on this I assumed there is no Fee. Correct me if I am wrong. Thanks, Vishy

“NOTE: If you filed a Form I-485, Application to register permanent resident or Adjust Status, as of Jul 30, 2007, no fee is required to also file a request for advance parole on form I-131. You may file the I-131 concurrently with your I-485, or you may submit the I-131 at a later date. If you file Form I-131 separately, you must also submit a copu of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485 as of July 30, 2007 “

You have to pay the new fee.

It takes 60-90 days to receive the AP document.

You have to go to your local District Office and PLEAD/BEG to the immigration officer to send a request to NBC to expedite the AP (this is of course after you filed for it and get the receipt notice). This may prove worthless though, as some offices will honor this request and some will not. Plus AP is for emergencies (originally) not for work/travel. But, you can try.

That's good to know. I would have to check that out also. I would imagine that the "AS OF JULY 30" meant for those who filed for I-485 (through marriage) after july 30th, and paid the new fee (of $1,010) they were the ones who didn't have to pay for the I-131 if filed later. But for people like myself and the OP who filed the I-485 before July 30th with old fees, we would still have to pay for I-131.

I better not take any more chances. I will send the check for $305. It makes sense anyway....Thanks for your advice. This forum is a great resource. I want to thank everyone who take their time to give valuable advice._V
