I'm planning to apply for advanced parole to leave for a short trip from US on July 15th.
Please help me with my questions.
1. If I apply for AP now, would i be able to get it before July 15th ?
2. Do I apply for it in the local office or VSC ?
3. My H1 expires by September 2003. If I dont get AP by July 15th can I still use my H1 to go and come back by August 15th ? Would I have any difficulty at the port of entry due to the short timeframe for H1 expire ?
Please provide me with your experiences and thoughts.
Thanks in advance.

If you have valid H1 (Not working on EAD) then you do not need AP and you could return from overseas till the last day on which the H1B expires.

FYI, you can go to your local service centre and get the AP on the same day (Required if your H1B is not valid).

Hope this helps !!

I too have valid HIB & have no AP,Iam working on h1b & is valid till 2004 jan ....but Iam expecting my I-485 approval anytime soon .....if my I-485 gets approved when Iam abroad can I reenter US with valid H1B ....Iam concerned b'coz I've no AP so if I can re enter with out AP with a valid H1B incase of my I-485 approval when Iam abroad I need not postpone my trip ....pls give me inputs I will gratly appreciate

1. Chances of getting AP approved thru Service centre b4 July 15 is slim.
2. Local offices issue only for 'emergency' needs.. Good Luck in that.
3. If you haven't used EAD so far, and have been on H1 so far, you can enter using H1, no matter how much time is left on the H1.[I entered once Dec end w/ visa valid until Feb 1 ]

Hope this helps
Good Luck

I have done this recently. My H1 was expiring on 25 May.

You have to go to the local BCIS office serving your area. take all the required documents, I-485 Receipt copies (MUST HAVE). If this is for NEWARK, NJ office then there is a different line for AP a.k.a Travel documents so don't waste your time in the big one. You can apply for an AP even when your VISA is valid. I hope you have the list of documents required for AP. Take 1 letter per applicant explaining why you need the AP. I mentioned relatives surgery, so you can call it an emergency if you feel like it. You will waste your whole day their (but worth it).

"You don't need AP if your VISA is valid on the date of your return". True, but if it's expiring soon, the INS officer at the immigration counter will ask you for some document that will show that you will be in status even after the VISA expires (e.g. new VISA petition copy, etc). I was asked that when I came back. I entered the US on AP even when my VISA was valid. I entered US on 5/11/03 and my VISA expired on 5/25/03.
