Advanced Parole - Family Health Emergency

My wife is living in the USA and has applied for permanent residence; we've received notice of receipt for I-485, I-130 and are at the stage where we are ready to get fingerprints and waiting for EAD to arrive. My wife still has a valid tourist visa for the USA. I am a USA citizen.

This morning we get a call from Brazil that her grandfather is in serious condition at the hospital. I'm sure this falls under emergency humanitarian reasons for the I-131 Advanced Parole - but how do we get authorization in one or two days instead of 60 days in advanced?

You should take the evidence of her grandfathers serious condition (a doctors note stating the fact) and go in person to your local district office. They will issue the advance parole that day itself.

Im in the same case, my wife's mother has problems .



To Whom It May Concern,


Mrs XXXX has had a CVA from a possible cerebral hemorrhage. She has residual paralysis on the right side and expressive aphasia. She will need extensive physical and speech therapy.
Her daughter is living in the USA and needs to come to Bulgaria to see her mother and be able to return to the US.
It is unclear at the time what the prognosis is with Mrs XXXXX.

Thats the medical letter that i got and i dought it will work
 
I am sorry to hear that & I hope your wife's mom is doing good

but this is strange.. INS should have granted your wife an I131 based on the family emergency.
 
Well, I wrote something similar to what is posted above - we'll go to our local office where we filed the I-485 in the morning with the I-131 and see how it goes. It is just going to be difficult to get information from the hospital or doctor faxed internationally. We could FEDEX it in a few days I suppose....

I'll let you know how it goes.
 
Ya on the subject , We even had a doctors note stamped from Bulgaria and faxed to us....I guess ceral hemerage isnt bad enough to let her go .

Ya let me know what happends , I got all proff here and it was useless , i had doctors letter and doctors note , both sighned and stamped, even had it all translated ......wasnt good enough for them ...
 
Sounds good to me , I guess me not being in Arizone doesnt help . Looks like i should have gotten the AP ? or did i get a bad I.N.S Agent to help us ? Is there anything i should do ? Or just swollow it and give up .

I believe it applies to all local service centers, as all of them are powered to issue interim APs, if conditions are met.

you should go back to the office and if they still refuse (demand that you talk to a supervisor) Also try and get your congressman involved..

Well i made another appt with my local office, I will be there at 3PM tomorrow "may 6th" Congressman only suggested me to go to the local office with the medical report . I will let you know tomorrow evening what happened .
 
Just got back from the I.N.S , they basically said we have to pay the 165.00 and refile the I-131 with them again tomorrow, then they get back with us withing 3/5 days after they review it ........

Tell me in your honest opinion ,,,what would you do in this case ? We have wasted a lot of money so far and were not sure what to do ...If we pay another 165.00 and they refuse it ......then what ..


We are very depressed over this issue ,I dont think i have ever been so mad in my life.

Do you think i have a good change of them approving this ?
 
That failed as well , the supervisor stated it need to be a life of death situation and they wil not provide us with a refund ......

I think the I.N.S just want to rip me off !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
