Advance Parole question

Me and my wife both have valid H1/H4 visas for another 3 years. My GC processing is in the final stage and we will receive EAD cards shortly. Do I need AP if i want to travel to India??? My lawyer says that we dont need AP if we never use our EAD cards. My wife is not working and I am working on my H1. So do we need AP???? Will it be safer to just go ahead and apply for AP? How many days does that take?

You don\'t need advance parole unless you start using EAD. If either you or wife have plan to use your EAD to work then apply now otherwise
you don\'t need. You can apply later also.
