Advance Parole Question - Urgent.

Hi,

I have an urgent issue regarding my AP. I received my approved AP from MSC (aka NBC) yesterday (I filed on May 3rd).

However, my first name is spelled incorrectly. I need to fly home (Ireland) on Wednesday for my sister's wedding. My first name was misspelled when I received my receipt notice from MSC. I called them and explained the error - the person on the line said the error would be ratifed. Obviously, it wasn't.

I'm afraid my current AP will be cancelled if I call NBC or go to my nearest district office. They will then order me a replacement and I won't receive it in time. Is this fear justified?

I would really appreciate some advice/help as I'm worried sick that I won't be able to fly home or get back in if I do.

If they let you board the flight in Ireland, and after you land here, I dont think it is a big problem here.

They can always link your AP to your 485 and to your "stay" history in US and to your passport. If it is a minor error, they should ignore it.

There is also some provision for delayed immigration clearance, I am not sure in what exact circumstances they fo it. They will not issue I-94 and give you 30 days or so to fix the problem. Then you can comeback to the entry post and get I-94.

They also spelled my first name incorrectly on my AP. My lawyer told me that just don't worry about it since they do this (mispelling) all the time.
 
I know it might be late. But I would not travel with AP that has incorrect name on it. I mean if it is just one letter and it is obvious that it is a misspell, then ylou might be OK, just take the copies of all the docs you have filed and all the notices that you have to prove that you are legite. However, if the misspeliing is serious and it does not look like your name, you might wanna delay your trip a day or two and see if you can schedule infopass for Monday/Tuesday... Good luck!

Thanks for your advice. I set up an infopass appointment yesterday and they issued me a new AP document. The guy in the Chicago District Office was a patronizing obnoxious clown! I just kept a tight lip when he tried to square the blame on me, even though it was their fault the misspelling was created and then not fixed. If I argued he could of easily done nothing for me. So I can head to the airport now without any worries :)

After talking to an attorney I'd seriously suggest setting up an appointment if any details on your AP are incorrect. Any lawyer that say it isn't important is just being lazy and doesn't want any extra workload.
