Advance Parole - how ong can you be out of the US?

I will be receiving my AP later this week hopefully (it was aproved 9/11 - RD 06/26).

I have been laid off 4 months ago and the IT industry does not look good. I have been trying hard get a new job with no luck.

I have been thinking to go back home for couple of months and come back ealier next year. 2 questions:

1-how long can I be out of the US?

2-will this be a problem on my green card process?

For the Validity of your AP, you can stay outside US.

Staying outside of US will pose a problem when you get a employment RFE, where you might have to produce an employment letter, Paystubs....

On a side note: Even if the market is tough... Don't give up. Its people like you giving up makes people like other get the jobs...Offcourse you uderstand your situation best..

what is an employment RFE? And do they usually ask for paystubs? I mean even if I stay in the US they might ask for the paystub, right?

I am still looking for a postion but it has been hard... few positions and 99% of they are looking for GC holders ONLY!

But lets keep the hopes up!

Nothing to worry

Since your reciept date is in June 2002, you can expect to get RFE ext in april or may 2003. Until then you can do whatever you want.

Sometime INS sends RFE for Proof of employment. Usually they ask for 3 latest pay stubs and employment letter. Please note an important point here. GC is for future employment and not for current employment. So therefore if you can get an employment letter at that time you should be fine. Your lawyer may have to fight for you a little bit.

I have seen some folks in this forum in a similar situation and they did get GC approved with Employment letter.
Some guys did not have jobs, so the INS has given then 6 additional months to get Job. ( good news)

INS officer has the discretion to do what deems best for him.
Usually they give additional time but sometimes they might be -ve.
Hey you are still have lot of time as Oct 2001 i-485 are not approved yet.

Do not worry at all. Relax go home and come back in Jan 2003 and then start applying for jobs.
