Advance parole expired at entry

My husband is a beneficiary of my 1-485 case based on employment that is pending. he traveled abroad with his advance parole current but at the time of entry, his AP has already expired (when he leave the US his AP was not expired yet). he had a deffered inspection date a few days ago and the office gave him another appointment in one month for anoter deffered inspection. What are his options since we have checked with some lawyers but they both gave us different advice. Will be his 1-485 abandoned?
 
Attorneys use the worse case scenario so you would retain them, don't get frustrated and lose hope, if it was a mere mistake on your husband's part and the AP was just expired and there are no other issues they might make a exception.
BTW how he was allowed to board a flight to US with a expired AP?

thanks for your advice. I also asked myself how they allowed him to flight if at the airport they are very stricted and they check everybody's accurate visa. I guess they did not know very well what an AP stands for
