Advance Parole and H1B Revalidation

Please advice what to do

I filed Concurently in the month of Dec'02 and got Advance Parole and EAD in march.

i-140 RD -08/12/2002

Did my H1b Renewal in the month of May'03 and got approved in the month of June'03.

I thought Advance parole is just a travle document and was under impression that it wont affect my h1b status.

Very recently i went to India and came back on Advance Parole.
and came to know that once i use advance aparole will cancel my H1b and was really shocked by knowing that.

My question to the gurus is

can i send to st lious for my h1 realidation..please advise me
what are my best options..
really tensed..

I don't know how you came to that conclusion but it is the opinion of BCIS that using Advance Parole to re-enter US does not change your valid H status. However if you use EAD to seek employment your H status expires automatically.
Please post how you came to this (incorrect) conclusion.

I got this information from immihelp.com and also from friends.

Idont know whether this information is accurate or not.

So as per your opinion even after using parole i can send
for H1b revalidation to st lious.right..

Please correct me if i misunderstood.

here are my detais

I140- RD Dec'02 AD ???
I485 - RD Dec'02
AP & EAD AP Mar'03

H1b expired in may'02 and got renewal in June'03(no visa)

used AP 'Aug'03

Once again my question is Can i send to St Lious for H1b Revalidation after using Advance Parole..

What will be the implications and once gain what are my best options.My worry is what if my i140 denies(i know thinking too far)
i will be out of status..(please confirm this)

Firstly why is there is a gap between H1 expiration and renewal?
Secondly you need a visa stamp only if you plan to travel outside US. When does your 6 years in H1 expire?
If I-140 is denied your H1 status continues to be valid.
 
Question on H1B status and Advance Parole

Hi,

I have a question, I applied concurrently to I140/I485, and my advance parole and EAD were approved recently, although my I140 still pending.

I was wondering if I travel outside the US, if I re-enter with the advance parole my H1B will still be valid. I dont want to risk losing my H1 since my I140 is not approved yet. I would have to use the advance parole to re-enter since I dont have the H1B visa stamped in my passport.

I would really appreciate any help in this issue.
