Hi,
I m new to this forum and am not sure if this is the right place to post. If this is the wrong place please pardon me.

Here is information regarding my case.
I-140 and 485 filed concurrently and pending.EB3 category. I m on H1 visa and my spouse is on F1 visa. We are planning to travel to india and have couple of questions

1. Do we have to inform USCIS that we are going out of country (feb 18th - mar 4th) since our case is pending? If yes, what is the procedure?
2. If we use advance parole what documents do we need to carry?
3. Can my spouse attain school on EAD?
4. If we use advance Parole, would we have problems travelling specially on return trip since there won't be any visa stamped in our passport?
5. What should we say at port of entry if they ask about visa?
6. Do you see any risk using AP and EAD and losing H,F status in the long run?

Any help in this matter is highly appreciated.

thanks and regards
Sur

1. Do we have to inform USCIS that we are going out of country (feb 18th - mar 4th) since our case is pending? If yes, what is the procedure?
>> NOT REQUIRED
2. If we use advance parole what documents do we need to carry?
>> IF YOU HAVE A VALID H1 & F1 THEN I WOULD SUGEST NOT TO USE IT UNLESS YOUR SPOUSE WANT TO WORK.
TAKE EAD, AP, H1, F1 & A LETTER FROM EMPLOYER SAYING THAT YOU ARE GOING ON A VACATION AND REJOING .. WITH YOU....
3. Can my spouse attain school on EAD?
>> YES
4. If we use advance Parole, would we have problems travelling specially on return trip since there won't be any visa stamped in our passport?
>> THEY WILL TAKE YOU IN A ROOM WHERE YOU NEED TO SIT FOR A WHILE OTHERWISE EVERYTHING WILL BE OK...
5. What should we say at port of entry if they ask about visa?
>> IF YOU HAVE VALID AP THEN NO PROBLEM
6. Do you see any risk using AP and EAD and losing H,F status in the long run?
>> I WOULD ADVISE KEEP YOUR H1, F1 AS LONG AS POSSIBLE....IF GC IS PENDING....
