Hello:

I am a Canadian Citizen residing in US on a Green Card Staus. Both me and my husband work in states and hold green card status.

We both are of OCI (Overseas Citizens of India).

We have been planning to adopt since 2 years with no luck. But now I came to know though my mother, that one of my relative is giving away a baby for adoption due to divorse and other complicated situtation.

I understand that it is impossible to adopt while holding a green card status.

Is this true ? Are there any laws that would allow me to adopt this baby and bring home and provide love and family to this baby ?

Can you please advise what the steps are ?

Thank you

Usha

A green card holder must live with the child for at least 2 years before being allowed to bring an adopted child to the US to immigrate. So in general, only green card holders who already adopted* the child before moving to the US can bring their adopted children.

How far are you from eligibility for US citizenship?

*or had the child living with them while pursuing official adoption

Thank you for a qick response. We just got our Green Card this June. So I am assuming anther 4 to 5 years for citizenship.
