Address Change

My lawyer changed their address last June'2003 and they told me they informed INS about it but the address change was not updated with INS.

Just because of that my RFE was sent to my address after 1(one) month. I informed INS about that issue when it got delayed..

RFE acknowledged by INS on May'03.

Today I received a letter(not in hand yet) from INS regarding AR-11 Form to change address.

Should I mention the address change of my lawyer in that form ???

Right now I am in a temporay address in NY. Permanent address is still in Oklahoma. So do they want my current address in NY as my Pay-stubs and Tax all is in Temporary address in NY..

I informed about the temporary address change also (Oklahoma to NY) long time back with AR-11.

Which address I should change.. any idea.

Thanks.

It is my understanding that you only need to send the AR-11 form if you change address, not your attorney. You do need to notify the Service center with which you have application pending about the attorney's new address since they act as your representative on this particular case.

So, if you filed the AR-11 already and INS acknowledged it, then you should be ok. I think whenever you change address with the Service center, they automatically mail you a reminder to file AR-11 form.

Just my thoughts.

Thanks for the reply...

But what I will write in the AR-11 .. they sent now...

Mine (Temporarily changed and informed already) or Lawyers one

I would probably call the 1-800 number and confirm that you don't need to send the AR-11 form since your address didn't change and also confirm that they have your current address on file. Let me know if you call and what they say.

I think the purpose of AR-11 form is to keep track of alien residents, so it wouldn't be right to give them your attorney's new address??

Hi Jharkhandi..

But my address is not changed...

I think this is because I faxed them 2 to 3 times after they sent it 2nd time as I didn't know about whats going on..

I will reply them anyway describing the situation.

I may talk to my lawyer(disturbing element) and will let you know.

Thanks.

Common Error

My lawyer told me that INS don't take change of address by phone anymore(not sure if its true).

BUT, Its a common mistake done by INS. If you file a 485 application with one address, and then file a AR11 later for a change of address- Then the INS database is updated of the new address, But the approval notices are sent to the address mentioned on the application(485 in this case).

This has happened to me all the time.

As for lawyers address. THIS IS TRUE FOR LAWYERS ADDERSS ALSO. My approval notice went to the lawyer's address. When my lawyer did not get the approval notice a week after the date - website mentioned, I called up the lawyer's office and asked them to check their previous address. BAM!!, There it was. I am glad I suggested this idea OR else I would have been dangling for a while.

I think the confusion is coming from the fact that if you file form AR-11 only, your pending application is not automatically updated. That is why it is recommended to send the AR-11 form AND a letter to the Service Center where your application is filed. At least that is what the customer rep explained to me when I moved. That is why I think you only need to file the AR-11 form when you change address, not your attorney. For your attorney's change of address you need to notify the service center only to make sure the communication related to your case is sent to the current address on file.

Hi Gurus

I am replying to that confusing letter today to the address mentioned there. I will explain in a seperate sheet of paper.

Do you think .. this will delay my process again. I already sent the RFE reply and it is acknowledged...

Thanks.
