Hi!

I have a pending I-485 petition based on EB-1EA category. The receipt date of 485 and other pertinent details are in the signature below. I have a question:

I recently got a job and moved to a new place last week. My family, though is still living on the same address which we mentioned on the 485 and will stay there for another 4-6 months. I checked with my attorney whether we need to file AR-11 (change of address) form (I think that form needs to be filed within 10 days), but my attorney suggested that we should not file this form right now as my family is still living at the same address, and it may have adverse effect on the case. I dont know what to do, because if I do not file this form, then I am not doing what is expected of me, that is inform USCIS of address change within 10 days, but my attorney is advising otherwise. So, dear wise friends, please guide what to do, and if it needs to be filed, how to go about it.

Thanks.

You file AR11 for yourself only and change the address with USCIS. You can do it for your family when it moves to the new location.

Thanks for the response moden. My question is, should I even do it or do Ineed to do it since my family is still living at the address mentioned on the form, considering that my attorney is against it?

Do it

What address is in your driver's licence? Make sure that you have that address with the DHS and USCIS. Is it clear now?

I still have MI address, the address that I filed on my 485 petition, on my driving license. But, I am planning to go for a MA license soon. Should I update the address only when I get a new license (it might be later than the 10 days limit set by USCIS) or now, even with my old license?

Thanks once again.

I suppose that your new job is of a permanent nature (not a temporary contract). So, I suppose that you will have an MA apartment and receive utility bills etc. at the MA address. Based on this I think you should intimate change of address for you and your family members at one shot. You could always say that your MI address is a transitionary address where your other family members are temporarily visiting from MA to wind down the establishment. As long as you have proof of address like rental agreement/utility bills etc it should be fine.
