Additional point for litigation

I am not sure if this point is already included in the current litigation or not. But if it is not then we should either include it or file a separate litigation.

BCIS’ website clearly says “If you received a request of evidence and you responded more than 60 days ago and have not received a decision, please call our National Customer Service Center at 1-800-375-5283”

Also, the RFE notice says that it will take them up to 60 days to make a decision after they have received our response. And it says we can call them if we don’t hear from them within 60 days.

There are many people (including me) who responded to the RFE and have been waiting forever. And when we call the National Customer Service, they say that currently Jan/Feb 2002 cases are being processed and they can't (but they really mean WON’T) do anything.

I called them yesterday and got the same response. When I said that the RFE notice and the BCIS website says that if we don’t hear from you guys in 60 days we should call. The response they gave was that those numbers (number of days) don’t mean much and that they cannot do anything else. Then I said, ok let me talk to your supervisor or some higher-level officer and the guy rudely said that’s not possible.


I would like for BCIS to answer why the RFE notice and the website say that if we don’t hear from them in 60 days we can call them, where as when we call them they say that the number (number of days) doesn’t mean anything and they can’t do anything and we just have to wait, wait and wait
