additional info??

checked the status of my wife's 3rd EAD.It said we sent you a notice asking for additional info. What do they mean by that? WHat additional info? WIll this delay her EAD? We are worried now! Please help!
 
RFE??

RFE? Request for evidence? What kind of evidence? After 3 eads? they need more evidence? Our EAD expires in Jan. I hope she gets it before that , the HR people at her company are already sending her notices!!! What to do now?
 
Most common RFE is I-140 reciept notice. If you have not enclosed it with your EAD appln. then that might be the RFE.
 
Who applied for you I-140? If it's your attorney, then he/she should have it. If your I-140 is approved, who has the approval notice?

Remember that I-140 technically belongs to your employer. You may not have the original. But a copy is enough. If the same attorney has been handling your case, he/she should have it.
 
A copy of I-140 could be obtained from your attorney or your company.

You really cannot say how much delay it causes. Depends on how soon your attorney responds to your RFE. By the way when did your online message change? I mean, if it more than 14 days and you still did not recieve a letter from TSC then it might not be an RFE. In this case you may want to call NCSC and make sure what that message means.
 
If you are the primary applicant, then it is NOT necessarry that your spouse should enclose your I-140 approval.

I think it could be a photograph issue. My wife received RFE for both her first AP and EAD for photographs. They said they could not find phots with the application... (On the contray, the AP she received had the old missing photos!!!)

the RFE ( whatever it is) will delay the process. Can my wife go to local INS to get temp EAD when RFE is pending? Which one will she go to? Atlanta or somewhere in Louisiana? ( we recently moved to Louisiana from Atlanta. PLease help!
 
If you are above 3 months

You could always get IEAD. Do not get worried too much.

Go to the local office and get an IEAD (valid for 8 months) if you have applied for more than 90 days. This is why, I always suggest to apply before 90 days of EAD expire. This is irrespective of they are approving EAD in 8 days or one year.

Do not worry too much, wait for the RFE and if 90 days have passed, plan to go to the local office and get an Interim EAD.
 
I am doubtful if IEAD will be issued in case of RFE. I read in this forum some time ago that when somebody got an RFE the local INS (not sure which state) did not issue them an EAD stating that they do not have permission to issue one in case an RFE has been issued. But it appears the rules differ from state to state in this regard. Check with your local INS.
 
The general rule at local INS is that they will not issue an iEAD if an RFE is issued. My friend's wife ran into this problem. Even a Senator could not help. He was told by the local INS to wait 90 days from the day a response to RFE is received by BCIS.

But the Senator was able to expedite the approval after a response was received by BCIS (I think it took a week).

hmcis, did you appy for EAD using the online process? If so, it may very well be for the digital photos.

no filed it paperbased. Like I did last year. If she doesnt get EAD by Jan 9, she will lose the job actually!!!

I am so lost now.
I am in Louisiana with my new job and rfe will be sent to Atlanta address (our neihbor wil lcollect our mail) then my neighbor will have to send it to me and I will respons eto that RFE. By that time I wont have enough time to apply for temp EAD. DAmn it!

Don't panic, Jan 9th is more than two months away. You should get the RFE in couple of weeks. After you reply to RFE contact your local Senator.

If I were you I would also try for Interm EAD, who knows they may give u iEAD.

There may be other options like taking vacation till she gets the EAD or apply for Leave of Absence in the worst case.
 
Agree with dinnu. Two months is a long time because of the rate at which most of the EAD's are approved these days. Don't dealy in getting in touch with your local INS office because this might require an appointment sometimes. If you call today you might get an appointment after two weeks also. So start persuing the matter with your Local INS office, and your Senator after you replied for your RFE.

Don't worry. Who knows, Local Ins may as well ask you to come down and collect the IEAD.:)
