Additional info requested for my case RD=Oct99

Hi All,

I after waiting for about hour hour on phone I finally got through to VSC. IIO told me that they have requested additional information in my case which is not sent out yet. She said it takes about 7-10 business days to do that.

I am guessing it is about Employment Letter etc. My guess is that it would be at least 3 more months before they can look at the case again (after I send RFE response etc.)

Just FYI. VSC is definitely making a progress. MY AVM has not been updated yet.

I think it will be much sooner before that before you get approval.. I have seen cases where within a week of getting
the RFE response, INS has approved cases.

Thanks for your mail. I am just hoping it is somethink simple (RFE) and they are not requesting W2s for 2000 (I haven\'t filed my taxes this year yet).

What would be simple is if they ask for a simple employment letter but may be it is wishful thinking.

Can someone tell what kind of RFEs are being sent these days?

Yes and no. Although my company has changed name very recently but VSC may not have any knowledge of it what-so-ever. I am saying this because I was never told my IIO that my casse is pending. Also my company is very small (under 100 employees, 5% might have applied for GC).

One theory is that old cases like mine (PD 3/96) have higher chances of receiving RFE.

If there wasn\'t any company name change then the RFE should be for Employment letter and paystubs. Try initiating with your company to get the necessary documents ready. Make sure you do your part promptly and leave it to INS. I don\'t think you have to wait for 3 months, my optimistic guess is 2-4 weeks after they receive the RFE reply. Good luck.

but I have seen a RFE post with 98 PD too..
I think if you havent submitted your taxes yet, your employer\'s w2 statemets will do (I am not sure what to call it w2 -
the ones that the employer gives you yearly so that you can file your taxes)..
be optimistic.. it will all be over very soon..

Thanks BJSR and metoo. I have started talking to my employer about the RFE.

Some of you might know my situation. I am giving it here and hoping to hear from some of you.

I filed I-485 with VSC in Oct99. My I140 and I485 are from same employer. Last Sep (Sep 2000), my company was bought out by another company. I did not know about this for a couple of months after I started receiving pay-checks with the new employer\'s tax ID. The management of my company says that they have saved letterheads with previous company name and they can send it if INS requests it.

Now since I do not know what kind of RFE is issued in my case. If it is for a simple letter of Employment from employer, I might be OK, but if they have asked for W2s for year 2000, it would be obvious (since they gave me 2 W2s for 2000) that my company was acquired and name changed etc.

I would like to know if it is possible to apply I140 redo with this RFE. I want the I140 redo to be linked my my I485 so that it gets priority and not get stuck in the regular queue.

Any suggestions.

W2 forms.After that how long it will take for approval

I dont know much about this situation.. I have seen fast approvals after 140 redos too.. those 140s seem to get
priority.. I remember thinking \' that is very fast!\' when I read how fast the 140 redo applications were approved..
I would suggest looking at posts of last month and Feb for the keyword 140 redo and see there..

Mera_kya_hoga, let us just wait for the RFE. It seems like VSC is approving the cases withoug I-140 redo RFEs lately(like in my case). I saw some of Mastech guys getting approvals with our I-140 RFE. If this is true in your case then the RFE should be just for your employment letter. But I don\'t know about your paystubs. If they ask for them and your paystubs are with the new company then it would be something your attorney has to work for your money. In my case the EB2 I-140 was filed very recently and my FPs were submitted only a week after that. So my case was fresh on the file and might have assumed the EB2 I-140 for the I-140 redo. There was a case in our company with an RFE for I-140 redo.

Incase the RFE is for I-140 redo then apply it right away and it will get processed in less than 4 weeks as it is just an amendement to the current I-140. This I-140 will be linked to your I-485 application. Once they receive this they should approve in 2-4 weeks.
So let us analyze the situation after you get the RFE and discussion with your attorney. Nothing to worry. The 180 days rule regulations are expected soon and you are going to be just fine.

I got a RFE for my case(layer received it today) and it is asking for employment letter and last 2 month\'s pay stub.

God only knows when this torture ends.

they have received RFE for my case. They have requested last
3 pay stubs, and W2 for 2000. The lawyer said that they did
