Hello! I have 2 questions about to add new evidences in a case.

If you want to add new evidence of your case, what is the best option? Send it through mail to USCIS before your interview? OR wait until your interview and bring theses evidences with you explaining in that moment to the asylum official about your intention to add theses evidences to your case?.

The second question is, in the case you decide you send the new evidences through mail to USCIS, what is the correct address to use as destination? Is the application center where you sent your applications initially (example Vermont application center, Nebraska application center) OR is the correct place the asylum office of your area? (For example Chicago Asylum Office, Los Angeles Asylum Office).

Same query from my side for the experienced old members here please.

Though, as per new law (effective 25th August 2020 by DHS) if we bring new evidence at the time of interview, it will be treated as "causing delay" in your case, hence it will become an ineligibility for EAD or work permit,

This is where you won't be able to apply for work permit reasoning "causing delay" because you brought new evidence at the time of interview. Because of this the Asylum officer won't be to make a decision right away and he will need more time, This situation for USCIS is "Applicant Caused Delay"

Exact Rule as under

  • No C(08) EAD for an Applicant-caused Delay: Under the new rule, USCIS will deny a first or initial C(08) EAD if an asylum applicant causes a delay in their asylum case before applying for a the C(08) EAD.
  • Applicant-caused delays include:
    • Failing to appear for an asylum interview.
    • Failure to pick up an asylum decision.
    • Requesting to submit additional evidence in support of an asylum application within 14 days before the asylum interview.
    • Failure to appear for a biometrics appointment.
    • Requesting to reschedule an asylum interview.
    • Filing a change of address if doing so causes the asylum case to be transferred to a new asylum office.
    • Failing to bring a competent interpreter to the asylum interview.
