adding my wife to the GC process

My I-140 petition was recently approved and the NVC in has received my case at this time.

They have assigned me to Mumbai for an interview.
I have not received the Packet 3 from the NVC yet.

At this time, I need to decide whether I can include my wife\'s name
(as my dependant) in the consular processing.

   My status in the US : H1B status
   My wife\'s status in the US - F1 status

Please let me know if it is legal for me to add my wife in the GC process now.

Yes You can include your wifes name as dependent in Packet3

I am sure you can include your wife\'s name as dependent. In OF230 include your wife name.

Sorry for asking this again - but does her F1 status not matter (F1 students are not supposed to have an intent-to-immigrate) ??

You\'ll get mixed responses for this one. In theory, F1 is not a dual intent visa. If a person desires to immigrate, s/he should be on a visa type that has dual intent (in this case, H1-B, H4, etc.)

However, many people claim to have sucessfully completed consular processing when the dependent was on an F visa. They have argued that only the primary applicant is subject to the "intent" criteria.
 
Not sure about F1 issue, but you can add your spouse

Chennai consulate clarified that you can add your spouse (I assume you got married after you sent your pkt 3). Send the consulate your revised DS230 part 1, OF169, wife\'s DS230 part 1 and a copy of your marriage certificate.
